BitGate App Privacy Policy

The BitGate app for Android and iOS is owned and operated by BitGate Services AS with organization number 922 385 734, and is developed by BitGate AS with organization number 918 574 433. BitGate Services AS is also referred to as “BitGate”, “us” or “we” in this Privacy Policy.

Your privacy is important to us, and this Privacy Policy describes how we collect and use personal information. The Privacy Policy is based on the legislation in Norway, where BitGate is located. We will at all times process your personal information in accordance with applicable privacy laws.

When we mention the Money Laundering Act in the Privacy Policy, we explain what, how and why we store such information in relation to know your customer and anti-money laundering.

What personal information we collect and why we collect it

User account

When logging in with BankID for the first time, an account is registered automatically. When you complete the login, you provide BankID with access to personal information about you. The following information will be stored about you:

  • National identity number
  • Your BankID identification number
  • First name, last name, and full name
  • Registered residential address
  • E-mail address
  • Phone number

BitGate is required by law to store your birth number, name and residential address. We must know who our customers are (KYC) and identify them in accordance with the Money Laundering Act. We do the identification with BankID and store BankID identification number and birth number as proof of your identity

If any of the information is missing, such as email and phone number, we will manually request that information before you can complete orders in the app. We need this information to be able to contact you when needed, for example when requesting information regarding orders.

Know your customer form

When we create a customer relationship, we are also required by the Money Laundering Act to know the purpose of the relationship. Therefore, we ask questions with several options. We require per the Money Laundering Act to store this information so that we know what your purpose of using the app is, in addition to being able to check whether your orders and behavior match the answered questions. In that case, we may ask you to update any questions or ask additional questions, or even provide additional information via email or phone. All additional information we request will be stored on the basis of the same regulatory reasons.

Order

BitGate is required to store personal information for all purchases and sales, both to comply with our accounting obligations and the Money Laundering Act. Furthermore, the IP address is also stored for security reasons, as an aid to look for suspicious transactions in accordance with the Money Laundering Act.

Contact form

When you contact BitGate using the contact form, the information we request is stored in the contact form. Your question allows us to answer it as soon as we see it and the contact information we need to answer your question. This information is also stored by email.

Log Data

Whenever you use our app, in case of an error in the app we collect data and information on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our app, the time and date of your use of the app, and other statistics. Only you can send this log data to our server by clicking a button in the app. Our support personnel may request the log data from you to investigate and resolve issues but it is optional to send it.

Cookies

Cookies are small files that are stored in your browser or on the device you use when you open a website. The app does not use these “cookies” explicitly. However, the app may use third-party code and libraries that use “cookies” to collect information and improve their services. For example, cookies may be used to:

  • Enable certain functions in the system.
  • Improve the security of your user account.
  • Provide insight into user behavior to improve the user experience.

Block and delete cookies

If you do not want cookies to be set when you visit a website, you can change this under settings in your browser. More information about this can be found under the documentation for your browser. Note that if you turn off the web browser’s ability to set cookies, it may affect the user experience and that some functions in the app may not work.

Embedded content from other sites

The app may include embedded content (eg videos, images, articles, etc.). Embedded content from other sites behaves in exactly the same way as if the visitor had visited the site from which the embedded content exists.

These sites may collect information about you, use cookies, embed third-party tracking systems and monitor what you do through this embedded content. This also includes tracking your actions via the built-in content if you have an account and are logged in to the site.

Links to external websites

Our app contains links to external websites. The owners of these websites may collect data about you. We recommend that you check your privacy policy before visiting them. We are not responsible for their use and collection of personal information.

Who we share your information with

Personal information is only shared if there is a valid basis for it. In the event of very high suspicion of criminal activity or upon request, we are required by law to provide information on ecocrime. Furthermore, we may release information to external services with your permission.

In order to use your data efficiently, and to offer you the best services, it is in some cases necessary to send information to third parties. These third parties have separate and independent privacy policies. BitGate is not responsible for the content and activities of the affiliated services. Nevertheless, we want to protect the integrity of the services we provide, and are happy to receive feedback in these areas.

Third party services

Our app may give you access to use or interact with third-party websites, apps, content, or other products and services. When you use third-party services, their own terms and conditions and privacy policy will apply to your use of these services. Use of third-party services is clearly indicated in the app by displaying the name and / or logo of that prominent place or by using words such as “powered by” or “service provided by”. Below we show the third-party services we use together with their terms.

How long we keep information about you

Your personal information is stored for as long as is necessary for the purpose or as long as it is required by law. The accounting obligation, the Accounting Act, the obligation to store, the Money Laundering Act and the obligation to report affect how long we have to store your information.

The app administrators, AML officer, order processing workers and customer service workers can view and edit this information.

Your rights regarding information we have about you

If you have a BitGate account, you can request an export file containing the personal information we hold about you. This includes all data you have given us. You can also request that we change or delete all personal information we have about you. This does not include information we are required to store for administrative, legal or security reasons.

How we protect your personal information

Information security is taken seriously. We ensure that your personal information is secure through technical and other measures. We take extra measures to prevent change, loss or abuse.

Only those who need your personal information will have access to it. In all cases, the information is treated confidentially.

Our routines for data leaks

If a data leak occurs, we are required by law to inform you about it. We will provide such information as soon as possible, after we have resolved the issue that caused the leak and consider it safe to release it. This is to prevent any further leakage. In all cases, you will receive information as soon as possible from us about a leak.

Which third parties we receive information from

We use third parties to collect information about you such as:

  • Personal information from BankID
  • Payment information from Neonomics
  • Customer service inquiries from Atlassian

Which automatic decisions are made on the basis of the users’ information.

You are automatically given access to carry out orders when we have received sufficient information about you and your identity has been verified as not suspicious in accordance with the Money Laundering Act.

If the system detects suspicious transactions or behavior of the user, the user will be temporarily stopped from using the app. Until we have manually contacted you and denied the suspicion, where we will restore your access again. We are also required to do this by law.

Children’s Privacy

This app does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from children under 13 years of age. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do the necessary actions.

Changes to terms

The Privacy Policy may be updated from time to time to reflect changes in the app, or by other legal and operational matters. This Privacy Policy is valid from 26.01.2021
